A commercial truck driver will be charged with DUI if his/her blood alcohol concentration is .04% or higher. This is significantly lower than the acceptable level of driving for non-commercial drivers.
The state has recently enacted stiff laws regarding commercial vehicle drivers who drive under the influence of drugs or alcohol. Effective October 1, 2008, all commercial drivers convicted of DUI will lose their CDL for one year from the date of conviction. The new laws also state that a commercial driver can lose his/her CDL even if he/she was arrested for DUI while driving a personal vehicle. A second DUI conviction will result in the permanent revocation of the driver’s CDL.
