DUI Breath & Blood Tests

The law states it’s a crime drive a vehicle with a blood alcohol concentration of .08%.  Blood alcohol concentration (BAC) refers to amount of alcohol in the bloodstream. When BAC gets too high, a driver’s physical abilities and mental alertness become significantly impaired, increasing the driver’s chances of causing a serious or fatal accident.

Any person found driving with a blood alcohol concentration that reaches or exceeds .08% will immediately be arrested and charged with DUI.  However, a police officer cannot possibly know for certain if a driver’s BAC is .08% or more without conducting a breath or blood test.  Breath and blood tests are the most common ways an officer can test a driver’s BAC to get the proof he/she needs to arrest and charge the driver with DUI.

Why do I need a West Palm Beach DUI Lawyer?

It’s important for anyone who submitted to a breath or blood test to consult with an experienced DUI defender as soon as possible. Police officers want people to believe that blood and breath tests are 100% accurate, and that the results of these tests cannot be contested. However, any good DUI lawyer will tell you that’s the farthest thing from the truth. Breath and blood tests are not 100% error proof, and often give inaccurate readings for a number of reasons.  Mechanical defects, radio frequency interference, broken machinery, defective lab equipment, operator error, and errors in the lab can all lead to an inaccurate reading.  A West Palm Beach DUI attorney with experience and skill, like the attorneys at Musca Law, will be able to point out this information to the jury to contest the accuracy and reliability of the test results.
